An order regarding parental responsibilities will usually include how extraordinary medical expenses are divided between the parents. However, it is not always clear what these extraordinary medical expenses are. Extraordinary medical expenses are uninsured medical expenses that go above $250 per child per year. These uninsured expenses can include copays, deductibles, dental treatment including orthodontia, vision care, or physical therapy. At the court’s discretion, extraordinary medical expenses can also include counseling or therapy sessions for a diagnosed behavioral or mental health disorder. While expenses that are not on the list may be included, the expenses included must be uninsured to be considered “extraordinary medical expenses.” By statute, extraordinary medical expenses are to be divided in proportion to the parties’ income, but the parties may agree to divide these expenses equally.
